Goldstar Travel Services Ltd. - Booking Terms & Conditions

THESE CONDITIONS FORM THE BASIS OF YOUR CONTRACT WITH GOLDSTAR TRAVEL SERVICES AND ARE LEGALLY BINDING.

1. Your Holiday Contract.
Before your booking is confirmed, you must sign a booking form accepting these conditions which are the terms of a contract which sets out the responsibilities of us, Goldstar Travel Services Ltd and you the customer. The form should be sent to us with the appropriate deposit or full payment arid your booking is taken to be confirmed when we despatch our, confirmation invoice to you or your Travel Agent. This Contract is subject to Manx Law and the exclusive jurisdiction of the Manx Courts.

2. Booking.
You may book through your Travel Agent who will make the booking on your behalf, handle all communications and provide an efficient local service. Your Agent will check availability with us and once you have decided, will complete the booking form, ask you to pay your deposit, holding any money paid as our agent under or in contemplation of a contract, If you prefer you can ring us directly and fill in the booking form and send it erect to Goldstar Travel Services, together with a crossed cheque or postal order for the deposit. All rates in this brochure include the appropriate VAT Rates as at 01.01.2003 and are subject to statutory adjustment.

3. Payment.
ON BOOKING — You must pay £75 per person. including each Child aged two years and over, unless a lower deposit is requested for shorter stays. If accepted this secures your booking. After all details have been checked a confirmation will be sent to you or your travel agent showing the amount of the deposit, the amount of the insurance premium paid and detailed terms and conditions of the insurance policy.

PAYMENT OF BALANCE
We will send you. or your Travel Agent, an invoice showing the full balance due for your holiday 8 weeks prior to your departure. For payment through your Travel Agent, for all package holidays and for all bookings falling within the TT period, you must pay the balance no Later than 4 weeks before your holiday is due to commence. Goldstar Travel Services reserve the right to cancel the booking and retain the deposit if the balance is not paid by then. When the balance has been received you will be Sent the holiday documents, vouchers and tickets.

If you have made your reservation direct with the Hotel and you have not booked a package tour, and travel costs are not included, then you may pay the balance of your accommodation charges after you arrive for your holiday. However, all accommodation for TT Race period must he paid in advance.

NOTE:
All clients taking package holidays based on sea crossings should make cheques payable to GOLDSTAR TRAVEL SERVICES TRUST. All other payments should be made payable to Goldstar Travel Services unless requested otherwise.

4. Sundry Accounts.
All extras purchased at the Hotel should be paid direct to the hotel prior to departure. Cheques are accepted for payment at the Hotel by prior arrangement and if supported by a bankers card.

5. Special Requests.
Additional requirements such as special diets, accommodation in specific rooms or on named floors should be specified at time of booking. Disabled or handicapped guests should also specify any special needs at time of booking.

6. Amendments.
In addition to any charges imposed by carriers any additional alterations to bookings after confirmation will be liable to a charge of £5 per person per alteration added to your final invoice. This charge may be waived when the change increases the value of the holiday.

7. Conditions of Travel.
When you travel by coach, air, rail, or sea, the conditions, by-laws and regulation pertinent to that carrier will apply.

8. Late Bookings.
Inclusive package holidays booked within 28 days of departure date, require full payment by return on receipt of invoice to facilitate dispatch of tickets and documents.

9. Brochure Descriptions.
Every effort has been made to ensure the accuracy of descriptions and information contained in this brochure. However, we are not always able to exercise day to day control over all the component parts of the holiday arrangements. It is always possible that an advertised amenity be withdrawn due to lack of demand, maintenance, renovation or act of God. We cannot accept liability for the loss of an advertised amenity in such circumstances.

10. Cancellations.
If you wish to cancel the holiday for any reason or any member(s) of your party wishes to cancel, we must be informed immediately by letter. We will charge cancellation fees (which may in some circumstances be covered by insurance) in accordance with the table below :-

11. Arrival, Departure and Temporary Absence.
Bedrooms will normally he ready for new guests from 2 pm on day of arrival. Rooms should be vacated by 11 am on the day of departure. Holidays begin with dinner on the day of arrival and end with breakfast on the day of departure. No allowance can be made for delayed arrival, temporary absence or premature departure.

12. Animals.
Regrettably no animals other than guide dogs for the blind are allowed.

13. Complaint Procedure.
We aim to provide a satisfactory service, in the event of you not being satisfied, please in the first instance, discuss the matter with your Hotel Manager, if you are still not satisfied please contact our offices. Correspondence cannot to entered into after the event unless the matter is raised and discussed during your stay.

14. Meals.
A full Table d'hote Dinner is served from 6.3O pm. Last orders at 8.00 pm. In peak season younger children have the choice of a special nursery tea at 5 pm in The Port Erin Royal Hotel or of eating with their parents. A late meal will be kept on arrival if you arrive by late plane or ferry - but we cannot guarantee that the full menu will be available. Our famous ‘Full House’ Manx breakfast is served from 7.45 am - last orders 9.45 am. On departure day a continental breakfast can be delivered to your room, before your departure by arrangement. No allowance can be made for meals not taken. Packed lunches are available on request. Light lunches are available at The Royal Hotel where light refreshments are served throughout the day. All restaurants are no smoking areas.

15. Credit Cards / Debit Cards.
We are happy to accept Visa or MasterCard, but we will charge you the 3% deducted from us by the credit card company rather than spread the cost to our cash customers. Payment by debit card e.g. Switch, Solo, Delta, Connect and Visa debit carries no surcharges but is subject to a £10 minimum transaction.

16. Consumer Protection.
The air holidays in our brochure are ATOL Protected, since we hold an Air Traffic Organiser's Licence granted by the Civil Aviation Authority Our ATOL. number is ATOL 3366. In the unlikely event of our insolvency, the CAA will ensure that you are not stranded abroad and will arrange to refund any money you have paid to us for an advance booking. For further information. visit the ATOL website at www.atol.org.uk The sea holidays in this brochure are protected in the Goldstar Travel Trust, a separate Trust account administered by an independent firm of English solicitors.

17. Price Guarantee.
We guarantee no surcharge on any full quotation made to you on a Holiday Option or Deposit Receipt, except for changes due to any later Government enforced surcharges, duties or taxes.

18. Air Travel.
No refunds are allowed after the first leg of the journey has been undertaken.

19. Supplements.
Sea view rooms are limited so a surcharge per person per night is made (not children sharing with adults). See individual hotel pages for details. Single room supplements are charged at a rate of £9.50 per person per night (but not for March or October).

20. Children's Rates.
Three children's rates are offered dependent on age and when sharing with parents. Children in separate rooms are charged youth rate regardless of age plus the relevant travel cost according to age. A child’s age is that at commencement of holiday.

21. Cancellations or changes made by us.
(a) Within our control; In the unlikely event we have to cancel or make major changes to your confirmed holiday, we will offer you an alternative holiday at no extra cost, and you may either accept this or cancel completely with full refund of all payments already made.
(b) Beyond our control; In cases of “force majeur" - events which we could not with all due care have foreseen or avoided (such as war, threat of war, riots, civil strife, terrorist activity, fire, flood, industrial dispute, natural or nuclear disaster, adverse weather conditions, technical transport problems, government action, port or airport closure etc) we have no legal liability for any resultant loss to you although some of these events may be covered by our Insurance) However we will still do our best to ensure your holiday goes ahead or that you are offered an alternative if this is possible.

22. Changes to Travel Arrangements.
When you book your package holiday we will give you the best information we have about the dates and times of your flights or sailings and airline and aircraft type if known. For early bookings we may have to wait to tell you until we are able to make the travel reservations. Travel details can be changed by the Airlines or Shipping Company and if so we will let you know as soon as we are informed. We are not liable for any loss or expense due to changes in travel in advance or at the time but for advance changes of port or airport or an alteration of timings by more than 12 hours, you may choose to cancel your holiday and receive a full refund.
